Welcome to Pelvin AI. These Terms of Service ("Terms") govern your access to and use of the Pelvin AI platform, including our website, applications, and any related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By accessing or using Pelvin AI, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you may only use the Service with the permission of a parent or legal guardian. By using the Service, you represent and warrant that you meet these requirements.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access. We are not liable for any loss arising from your failure to keep your credentials secure.

You agree to provide accurate, current, and complete information during registration and to keep that information updated.

4. Acceptable Use

You agree not to use the Service to:

• Generate, distribute, or promote illegal, harmful, or fraudulent content
• Create content that infringes on the intellectual property rights of others
• Impersonate any person or entity, or misrepresent your affiliation
• Generate content that sexualizes minors, promotes violence, or incites hatred
• Attempt to bypass usage limits, rate limits, or authentication controls
• Reverse-engineer, scrape, or overload our infrastructure
• Use the Service to build a competing product without written permission
• Violate any applicable law or regulation

We reserve the right to suspend or terminate accounts that violate these rules, with or without notice.

5. Content & Intellectual Property

Your content

You retain ownership of any prompts, text, or other inputs you submit ("Inputs") and any outputs generated specifically for you ("Outputs"). You are responsible for ensuring that your Inputs do not violate any law or third-party rights.

Our service

The Pelvin AI platform, including its design, code, logos, and trademarks, is owned by Isaiah David Oghenefejiro (Pelvin Nero) and is protected by copyright and other intellectual property laws. You may not copy, modify, or redistribute the Service without written permission.

Third-party models

Some Outputs are generated using third-party AI models (for example, Prodia, Leonardo, Magic Hour, and OpenRouter). Your use of those Outputs may also be subject to those providers' terms. We do not claim ownership over those underlying models.

6. Payments & Subscriptions

Paid plans are billed through Paystack, our payment processor. By subscribing to a paid plan, you authorize us to charge your chosen payment method on a recurring monthly basis until you cancel.

• All prices are displayed in Nigerian Naira (₦) unless otherwise stated
• Subscriptions renew automatically at the end of each billing cycle
• You may cancel at any time from your dashboard
• Cancellation takes effect at the end of your current billing period

7. Refunds

Because our Service delivers digital content immediately upon use, payments are generally non-refundable. If you believe you were charged in error, contact us within 7 days of the charge and we will review your case in good faith.

8. Service Availability

We strive to keep Pelvin AI available 24/7 but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, upgrades, or third-party outages (for example, from our AI providers or Paystack). We are not liable for any interruption.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if required by law. Upon termination, your right to use the Service ends immediately, but sections that by their nature should survive (such as disclaimers and limitations of liability) will continue to apply.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. AI-generated content may be inaccurate, incomplete, or unsuitable for your specific purpose. You are solely responsible for reviewing and validating any Outputs before relying on them.

11. Limitation of Liability

To the maximum extent permitted by law, Pelvin AI and its founder shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes will be communicated by email or through the Service. Continued use after changes constitutes acceptance.
